Dhara 370 ke karn hi jammu aur kasmir ka apna alg sanvidhan tha tatha jammu kasmir me shasan vyavastha rajya sarkar ke dwara chalayi jati thi . is article ko 17 november 1952 ko lagu kiya gya tha.

Yeh dhara jis v rajya me lagu rahti us per suprim court ka bhi koi niyam lagu nahi hota . tatha us rajya per Kendra sarkar ki kuch simit nitiyan hi lag hoti thi jaise ki raksha, videsh mamle, tatha sanchar  isko chhod ker koi niyam kanun banana ke liye Kendra sarkar ko rajya sarkar se manjoori leni padati .

15 august 1947 ko jammu aur kasmir v azad ho gya tha , lekin india ke pahle governer  lard Mountbatten ne sabhi riyayto ko chhoot de di thi ki vo ager chahe to india ke sath mil skte hain ya fir svtantra rajya ki tarah hi rah skte hain. Us samay jammu aur kasmir ke raja haari singh ne bhart se milne pe  mana kar diya tatha apna svtantra rajyya ki ichha jahir kiya.

20 october 1947 ko Pakistan ne jammu kasmir per attack kar diya aur kafi hissa par apna adhikar kar liya.

Is paristhiti me raja Hari singh ne india se help ki guhar lagayi , lekin india help karne se pahale kuchh shert  rkakhe jiske parinam svaroop india ke prime minister jawhar lala neharu ne apne khas dost shekh abdula jo jammu aur kasmir ka khas himayati tha  ke sath mil kar 26 october 1947 ko jammu aur kasmir ke sath bhart ki asthayi vilay ki ghosna ker di jisme Kendra sarkar sirf raksha , videsh mamale tahta sanchar mamle ko chhod ker kisi bhi mamale me hastkshep nahi kar skta. Thatha jammu aur kasmir apni niyam kannoon banne ke liye purn roop se swtantra hoga.

• Jammu Kashmir ka apna sanvidhan tha aur iska prasashan isi ke anusar chalta tha. Na ki bhart ke sanvidhan ke anusar.

• Kashmir ke logon ko dohari nagrikta mili hue thi , ek Kashmir ki aur dusari India ki.

• Is article ke anusar central gov. bina state gov. Ke anumati ke bina iska nam, kshetrafl aur sima me koi bhi parivartan nahi kar sakti

• Central gov. sirf raksha, videsh mamale aaur sanchar ke kanoon bana sakti thi.

• Jammu aur Kashmir ke pass 2 jhande the, ek Kashmir ka apna rastriya jhanda aur dusra bharat ka tiranga jhanda.

• India ke kisi bhi durase state ke log jammu Kashmir me koi sanmptti nahi kharid sake the.

• Ager koi Kashmiri mahila kisi dusare state ke ladke se shadi kar leti to us ladki ki Kashmir ki nagrikta smapt ho jati , lekin ager vahi ladki kisi Pakistani se shadi kar leti  to uski Kashmiri nagrikta per koi phark nahi padta tha

• Koi Pakistani ladaka ager kisi Kashmiri ladki se shadi kaar leta tha to us ladke ko apne app hi india ki nagriktaa mmil jati thi.

• Aam taur per ye dekha jata hai ki ager koi bhi bhartiya nagriktaa ko chhod ker ager kisi dusre desh chala jat hai to usaki india ki nagrikata vahi per khatam ho jati hai , lekin jammu Kashmir ke sanderbh me esa nahi tha , jammu Kashmir ka koi nivasi ager Pakistan chala jata aur agre baad me vah kabhi bhi vapas kasmir ataa tha to usko india ki nagrikata mil jati thi.

• Jammu Kashmir me bharat ke rastriya pratikon rastragaan, rastriya dhvaj, aadi ka apmann karna koi apradh nahi manan jata tha.

• Article 370 ke karan hi yahan per  vitiya apaat kal article 360 nahi lag sakta tha.

• Bharaat ke sanvidhan me kiya gya koi bhi sansodhan jammu Kashmir me  lagoo nahi hota tha , ise lagoo karane ke liye  rastrapati ki vishesh anumati ki jaroorat hoti thi.

• Rajya me gov. job ke liye sirf jammu kshmir ke sthayi nagarik ko hi mauka milta tha aur scholarship bh unhi logon ko diya jata tha.

Article 370 hatane ke baad jammu Kashmir ki sthiti

5 August 2019 ko article 370 ko  hatane ki ghosana ki gayi aur 6 august 2019 ko samapt kar diya gya hai

 iske sath hi article 35A bhi apne app purn roop se prabhavhin ho gayi jo ki jammu Kashmir ko apni paribhasa bdlane ka adhikar deti thi. isko 14 may 1954 ko tatkalin rastrapati dr.Rajendra Prasad ne Jawahar lal neharu ke paramrs per lagu kiya tha.

Jammu akshmir ko 2 hisson me bant diya gaya hai. Jammu Kashmir aur laddakh . ye dono hi Kendra shashit pradresh honge

Article 370 samapt hone ke bad jammu kshamir ka vishesh rajra ka derja samapt hho gya . baki rajyun ki tarh yhan per bhi bhart ka sanvidhan puran roop se lagu hoga . india ke kishi bhi kshetra ka nivasi jammu kasmir me invest kar skta hai ,jamin kharid satkta hai , kasmir ki ladkiyan ab kisi bhi rajya ke ladke se se shadi ker kati hai uski nagrikta per koi ferk nhi padegga.
